Partner Visas

If you are in a genuine and committed relationship with an Australian citizen, Australian permanent resident or eligible NZ citizen, then you may be eligible to apply for an Partner visa. This visa category accounts for around 25% of Australia’s migration program – the largest in the family stream.

The Partner visa categories are:

Prospective Marriage Visa (subclass 300)

This visa allows you to enter Australia for the purpose of marrying your prospective spouse and then apply for the Partner visa. Obtaining this visa is the first step towards a temporary Partner visa (subclass 820).

Eligibility:

You must have met your partner in-person.

  • Be 18 years old or older
  • Be sponsored by your Partner
  • Intend to marry your prospective spouse within 9 months of visa grant

Partner (Provisional) Visa (subclass 309)

This visa allows the de facto partner or spouse of an Australian citizen or permanent resident to live in Australia on a temporary basis. Obtaining this visa is the first step towards a permanent Partner Visa (subclass 100).

Eligibility:

Usually your relationship must have existed for at least 12 months immediately before the application is lodged. Time spent dating or in an online relationship may not count as being in a de facto relationship.

  • You are committed to a shared life to the exclusion of others
  • Your relationship is genuine and continuing
  • You live together or do not live separately and apart on a permanent basis
